These Terms of Service govern your access to and use of MentionX.ai (“MentionX”, “we”, “us” or the “Service”).

1. Business Use Only
MentionX is intended exclusively for businesses, entrepreneurs and professionals acting for commercial or independent professional purposes.
By purchasing a MentionX subscription, you confirm that you are using the Service for business or professional purposes and not primarily as a private consumer.
2. The MentionX Service
MentionX provides AI visibility and analytics tools that analyse publicly available company information and responses generated by artificial intelligence platforms.
Depending on the selected plan, features may include:
• AI visibility analysis
• brand mention tracking
• competitor analysis
• citation and source analysis
• AI-generated recommendations
• recurring monitoring and reporting
MentionX is continuously developed. We may add, modify or remove features where reasonably necessary to improve, maintain or operate the Service.
3. Accounts and Access
You are responsible for providing accurate account information and maintaining the security of your account.
You must not share access in a way that circumvents the limits of your subscription or allows unauthorised use of the Service.
You are responsible for activity carried out through your account unless caused by circumstances outside your reasonable control.
Please contact us if you believe your account has been accessed without authorisation.
4. Subscriptions, Billing, Cancellation and Refunds
Paid MentionX plans are billed in advance on a recurring monthly or annual basis, depending on the plan selected at checkout.
Payments and subscriptions are processed through Stripe.
By starting a paid subscription, you authorise recurring charges to your selected payment method until the subscription is cancelled.
The applicable price, billing frequency and included usage are displayed before purchase. Applicable taxes may be added where required.
Subscriptions automatically renew at the end of each billing period unless cancelled before the next renewal date.
You may cancel your subscription at any time through the available account or billing settings or by contacting dj@mentionx.ai.
Cancellation prevents future renewals. Unless otherwise stated, access to paid features continues until the end of the billing period already paid for.
Subscription payments are generally non-refundable once a billing period has started.
We may provide a refund or account credit where appropriate, including for duplicate charges, confirmed billing errors or prolonged technical failures that materially prevent use of the Service.
Any refund outside a statutory entitlement is provided at our reasonable discretion.
5. Acceptable Use
You may not use MentionX to:
• violate applicable laws or third-party rights
• interfere with or disrupt the Service
• attempt unauthorised access to MentionX systems
• introduce malware or harmful code
• circumvent subscription, usage or security limits
• use automated methods to overload or abuse the Service
• reverse engineer the Service except where expressly permitted by applicable law
• use MentionX for fraudulent, deceptive or unlawful purposes
We may restrict or suspend access where necessary to prevent abuse, security risks or material violations of these Terms.
6. Intellectual Property
MentionX, including its software, interface, branding, methodology, reports, analytics systems and underlying technology, is owned by or licensed to MentionX and is protected by applicable intellectual property laws.
Your subscription gives you a limited, non-exclusive and non-transferable right to use the Service for your internal business purposes while your subscription remains active.
You may use and share reports and insights generated for your organisation for legitimate business purposes.
No ownership rights in the MentionX platform or underlying technology are transferred to you.
7. AI-Generated Information
MentionX relies on artificial intelligence systems, publicly available information and third-party services.
AI-generated results may occasionally be incomplete, inaccurate, outdated or inconsistent. Results may also change between scans or between different AI providers.
MentionX does not guarantee:
• that a particular AI platform will mention or recommend your company
• that results will remain identical over time
• specific AI visibility rankings or positions
• increases in traffic, leads, sales or revenue
• that third-party AI platforms will remain available or operate in the same manner
MentionX provides analytics and decision-support information. You remain responsible for business decisions made using information provided by the Service.

8. Third-Party Services and Availability
MentionX relies on third-party technology providers, including AI platforms, infrastructure providers and payment processors.
Temporary interruptions or changes may occur because of:
• maintenance
• infrastructure issues
• third-party API outages
• changes made by AI providers
• security incidents
• technical upgrades
We aim to provide a reliable Service but do not guarantee uninterrupted or error-free availability.
We may modify or discontinue features where reasonably necessary for technical, security, legal or product reasons.
9. Liability
We are liable without limitation where liability cannot legally be excluded, including for intentional misconduct, gross negligence and injury to life, body or health.
In cases of ordinary negligence, liability is limited to breaches of essential contractual obligations and to damage that was reasonably foreseeable and typical for this type of contract.
Mandatory statutory liability remains unaffected.
MentionX is not responsible for business decisions based solely on AI-generated information or for changes, errors or outages originating from independent third-party services outside our reasonable control, subject to mandatory applicable law.
10. Suspension and Termination
You may stop using MentionX or cancel your subscription at any time.
We may suspend or terminate access where:
• these Terms are materially violated
• subscription payments remain unpaid
• the Service is being abused
• continued access creates a security or legal risk
Where reasonably possible, we will provide notice before suspending or terminating an account unless immediate action is necessary.
11. Changes to These Terms
We may update these Terms when reasonably necessary due to changes to MentionX, applicable laws, pricing structures or third-party services.
Material changes affecting an active paid subscription will be communicated appropriately before taking effect where required.
The latest version of these Terms will always be available on this page.
12. Governing Law and Contact
These Terms are governed by the laws of the Federal Republic of Germany.
Where legally permissible, Berlin, Germany shall be the place of jurisdiction.
